The Owner is responsible for ensuring the boat has all of the safety equipment required by law and all government agencies for the waters in which the boat is being used, including but not limited to life jackets, fire extinguishers, etc.
BackPrior to rendering the Owner’s Boat available for rent, Sailo requires the Boat to have received an Initial Boat Certificate of Condition (“Certificate of Condition”) performed by an approved Sailo Affiliate or a Vessel Safety Check performed by the U.S. Coast Guard Auxiliary. It is the Owner’s responsibility to make sure that Regularly Scheduled Maintenance (“Maintenance”) for the boat is in accordance with all government and manufacturer recommendations. Upon request by Sailo, the Owner is responsible for providing an up-to-date proof of maintenance to Sailo. Such proof of maintenance shall be submitted in the form of acceptable documentation signed by an accredited Marine Surveyor. Should the Owner fail to provide evidence of Maintenance, i.e. the completed survey (“Survey”), Sailo may suspend the Boat from the Sailo website and associated Service until acceptable proof of maintenance is received.
BackThe Owner is responsible for maintaining the Boat in a way that is safely operable by any Captain, and available for operation at all times. The Owner may not place in the Boat any modifications, devices, equipment or other items that may interfere with the safe operation of the boat or are not endorsed and/or approved by the manufacturer.
BackThe Owner is responsible for making sure that the Boat is clean at the start of each rental period.
BackThe Owner, or a delegate sourced by the Owner or through Sailo, is solely responsible to review all safety features, vessel operation procedures, peculiarities of the boat, conditions of use and documentation of conditions of the boat prior to the start of any rental. In addition, the Owner, or a delegate on his behalf, is solely responsible to verify that all U.S. Coast Guard required safety items are on the boat, accessible and in working order. Any damage that is not documented by the Owner prior to the rental is solely the responsibility of the Owner (for dispute resolution procedures, see Terms of Service).
BackThe Owner is required to maintain and keep the proof of insurance (‘Proof of Insurance’) on board at all times. In the event of an accident, Sailo may also require that Owners be able to access their insurance policy information electronically and email a copy of the information to other parties involved. Moreover, the Sailo Insurance Policy, available through Sailo, shall cover damage and liabilities in the amount stated by the Boat Owner or the actual paid cash value, whichever is the lesser. Third party liability provided by Sailo shall not exceed $1,000,000 combined single limit. Medical payments are not covered. To report a claim the Owner should contact claims@sailo.com within 18 hours of the incident.
